WHY MSME ODR

Under the MSMED Act, 2006, registered Micro and Small Enterprises are entitled to receive timely payments for goods supplied or services rendered. Delayed payments continue to choke working capital for lakhs of MSMEs, despite statutory protection.

Understanding the MSME ODR Scheme

What is MSME ODR?

The MSME ODR (Online Dispute Resolution) Scheme is a Government-backed digital framework that allows Micro and Small Enterprises to recover delayed payments through an integrated online system combining voluntary negotiation, statutory conciliation, and arbitration under the MSMED Act, 2006.

How is MSME ODR different from traditional MSME Samadhaan?

The traditional MSME Samadhaan portal primarily records complaints and forwards them to the Facilitation Council. The MSME ODR Scheme expands this by adding structured online negotiation, guided conciliation, and binding arbitration — all conducted virtually for faster resolution.

Who can file a case under the MSME ODR Scheme?

Any registered Micro or Small Enterprise supplying goods or services and facing delayed payments beyond the agreed period or statutory limit can file a case under the MSME ODR framework.

Do I need to be registered as an MSME to file?

Yes. The MSMED Act applies only to registered Micro or Small Enterprises. If you are not yet registered, we can assist you in obtaining a valid Udyam Registration Certificate before filing your claim.

How do I authorise you to represent my MSME?

You simply provide us with a signed letter of authority and any other required forms. We prepare all drafts for your signature and guide you on when physical signatures or e-signatures are needed.

Process & Timeline

How long does the entire ODR process take?

  • Pre-MSEFC Negotiation: 15-30 days (voluntary)
  • MSEFC Conciliation: Usually within 90 days
  • Arbitration: Additional 90-120 days, depending on complexity

Most cases resolve at the conciliation stage itself.

What if the buyer refuses to participate?

Once an arbitral award is passed, it is legally enforceable like a civil court decree. If the buyer fails to comply, we advise you on execution steps — including filing for recovery in a competent court.

Can I withdraw my case if my buyer settles directly with me?

Yes. If your buyer clears dues after filing, you can withdraw your application at any stage. We help you draft a legally sound settlement and withdrawal statement to avoid future disputes.

How much do you charge for your services?

Our professional charges depend on the claim value and complexity but are always transparent. We offer stage-wise fixed fees so you know exactly what you’re paying for at each step. Please contact us for a detailed quotation.

Will there be any Government fee as well?

Apart from our professional charges, there may be nominal application/documentation charges on the portal, but these are minimal. The Government also provides limited financial assistance (up to Rs. 4,000) towards documentation and application costs.

Location & Accessibility

Do I have to visit your office physically?

Not necessarily. Our entire process is designed to work remotely. We collect all documents, draft your claim, file it online, handle notices, and represent you virtually. However, we have physical offices in major cities should you wish to meet us in person.

Can you help if my buyer is in another state?

Yes. We can handle cases pan-India. The Facilitation Council’s territorial jurisdiction is based on your MSME’s registered address, not the buyer’s. We coordinate all filings and hearings remotely.

Will I have to appear for hearings?

Most communication happens online. If conciliation or arbitration requires your appearance, it can often be handled through video conferencing. If needed, we guide you through every step.
